Suffolk Judicial Diversion Program
 
The Suffolk County Diversion Program is collaborative effort between the Suffolk County Probation Department and the County Court to provide supervision, substance abuse treatment and case management to those who agree to first plead guilty to certain drug related felonies. For those who successfully complete the program, it is possible to have their felony charges completely dismissed.

Eligible defendants include non-violent substance dependent individuals who have been indicted on felony charges of sale of a controlled substance and other crimes driven by addiction. To be admitted into the diversion program, defendants must first enter into a contract with the County Court and plead guilty up front. The contract spells out what the court will require of the defendant and the agreed upon outcome upon successful completion, as well as the outcome should the defendant not successfully complete the program.

The program excludes those convicted of violent crimes, sever or persistent mental illness, as well as those with certain medical conditions that may interfere with the participant completing the requirements of the program.

Entrance into the diversion program requires a referral from the County Court Judge overseeing the case. Admission into the Suffolk County Judicial Diversion Program remains in the sole decision of the presiding judge.
