Misdemeanor Convictions

A misdemeanor conviction is less serious than a felony conviction; however a conviction to a misdemeanor will result in a criminal record nonetheless. A defendant convicted of a misdemeanor may be sentence to up to 1 year incarceration depending on the type of misdemeanor the defendant has been convicted of. 
 
In New York State there are 3 types of misdemeanor charges.
 
An “A” Misdemeanor carries a sentence of up to 1 year incarceration and probation of 3 years.
 
Some “Unclassified” Misdemeanor such as Misdemeanor DWI may carry a sentence of up to 1 year incarceration or 3 years’ probation, as well as a combination of up to 60 days jail and 3 years’ probation.
 
A “B” Misdemeanor carries a maximum sentence of up to 3 months incarceration or 1 year probation, or a combination thereof.
 
In Suffolk County, the most misdemeanor cases are sent to the Suffolk County District Court in Central Islip, or to one of the town courts located on the east end of Suffolk County, such as the Riverhead Town Court, the Southampton Town Court, the Southold Town Court, and the East Hampton Town Court. Other misdemeanor charges may be returnable to one of the village or justice courts located throughout Suffolk County.
