Murder

In Suffolk County, those charged with murder will usually be arraigned in court room D11 at the First District Court in Central Islip. Bail will be set, and the defendant will be indicted by the next court date (within 6 days). The case will then be transferred to the County Court in Riverhead.

Under New York Law Murder is defined as the killing of a human being by a sane person, with intent, malice aforethought and with no legal excuse or authority.

If a person intentionally or recklessly causes the death of another person, that person may be charged with Murder. There are several different offenses in the New York Penal Code that deal with the taking of the life of another person. These include homicide, manslaughter and murder. Of those crimes, murder in the first degree, murder in the second degree, and aggravated murder are the most serious. Each of those offenses is categorized as a Class A-I felony, a conviction to which could result in a sentence of life in prison.
